Conditions:
1. Highest or any Offer not necessarily accepted.
2. Bidding will be conducted by ongoing tender. Once all qualifying bids are received, the top 3 bidders will be informed of the highest bid on each quarter they have bid on. Bidders will then be provided the opportunity to declare their bid final or to increase their bid at least 2% above the last highest bid. Once all bidders have declared their final bid the bidders shall be informed of the Vendor's decision. Only the top 3 bidders will be eligible to re-bid.
3. All bids must be in writing and accompanied by certified payment in the amount of $10,000 per quarter bid on, payable to Battle River Law in Trust. Payment will be returned without interest if offer not accepted.
4. Closing Bid Date: March 19, 2026.
5. Possession Date: Within 15 days of obtaining consent of beneficiaries or court approval.
6. Acceptance is subject to approval of beneficiaries of the Estate or Court Approval, to be obtained by Vendor.
7. Balance of purchase price for the successful offer, plus GST (if applicable), to be paid to Battle River Law in Trust on or before the Possession Date or the deposit will be forfeited.
8. All 2026 property taxes payable by Purchaser.
9. Successful offeror(s) to enter formal purchase agreement following tender.
10. Land to be sold as one package or as individual quarters. *NOTE: All LSDs in NW 31 are tied and must be sold together. Also NW 2, SW 2 and NE 3 must be sold together for access reasons. Package bids must specify price offered for each quarter.
11. Property, including the home and outbuildings, sold "as is"
12. Vendor to have access to the yard to remove scrap metal and personal property until August 31, 2026. All items on the property thereafter remain with the Purchaser.
